Here are the highlights:

In 2012, the Federal Communications Commission unveiled new rules under the TCPA, which became effective on October 16, 2013. Provisions include:

  • Prior express written consent for all autodialed or pre-recorded telemarketing calls
  • Abolishment of “established business relationship” exception
  • Requirement of interactive opt-out mechanism
  • Tightening limits on “abandoned” calls during the course of an advertising campaign
