What does chapter 7 bankruptcy do to my student loans?
In a large majority of cases, you will still owe your student loan debt after a Chapter 7 bankruptcy.
Generally, student loan debt is not dischargeable in a Chapter 7 bankruptcy.
However, there is a limited exception provided for in the case law that provides for a fact sensitive test. This requires a special adversarial proceeding to be filed and a hearing by the Bankruptcy Court. This is a difficult standard to meet but sometimes it is worth investigating to see if you qualify.
