“A man’s home is his castle” — so what does this mean when we are threatened with losing our home? It means we are in a very serious situation and the mortgage company threatening us with foreclosure better make absolutely sure it has the legal right to threaten us with foreclosure.
There are three stages to foreclosure. At each stage there are dangers and opportunities to stop or reverse the foreclosure.
First, there is the activity leading up to the foreclosure itself. This is the stage where you normally try to work with the mortgage company to do a loan modification or what is called “loss mitigation” to avoid the foreclosure. Often the mortgage company will lie and deceive you in this stage by pretending to help you while actually working to take your home through a foreclosure. There are very strict federal laws now (as of January 2014) the provide great protection to you IF you take advantage of the protection the law gives you.
Second, there is the foreclosure itself. We have seen mortgage companies try to foreclose on the wrong date, in the wrong county, and to not even actually do the foreclosure itself at the front entrance of the courthouse. You have to protect yourself if you reach this stage by being at the courthouse entrance (outside) during legal hours on the day of the scheduled foreclosure. You have an opportunity to fight back when the mortgage company refuses to follow the law.
Finally, there is after the foreclosure. You will be told to leave. You will be threatened with a lawsuit if you don’t leave. You have, if you follow the law, a right to redeem your property. If you don’t leave in time, you will be sued for eviction — what the law calls an “ejectment lawsuit” to force you out of your home and hit you with money damages. You can sue the mortgage company in federal court or counterclaim against them when they sue you for ejectment. We have represented homeowners who have vacated (set aside) the foreclosure and gotten back on with their lives enjoying their homes. It is difficult, but possible so don’t give up hope.
