Why should you take this seriously about the date of a foreclosure?

This company sent you the notice because they pulled public records showing a foreclosure is coming up very soon — within 3 weeks.

Now it could be bad information but normally this company will get the fact of a foreclosure — and the date of the foreclosure — correct.

So even if you don’t think you have a foreclosure, check it out.

Few options for you:

  • Call your mortgage company and see if a foreclosure is set
  • Go through your mail and see if you have any letters from your mortgage company or a foreclosure lawyer telling you there is a sale date
  • Call us at 205-879-2447 and we can look it up for you using several online services

It would be a shame to assume everything is good and then be foreclosed.  We have been helping families for many years fight against foreclosures and it is not unusual for one spouse to know a foreclosure is happening and the other spouse to be completely in the dark.

And if no foreclosure sale is scheduled, then “false alarm” and go about your business.

But take advantage of this warning to see if you do have a foreclosure set.

It appears they are out of Atlanta, Georgia.

I do not see a website and their physical address appears to be a UPS type store.  In other words a mailbox in the store.

Now there is nothing wrong with using a UPS store but you do have to consider whether you want to do business with a company in Georgia that has no physical address and claims to be able to help you stop a foreclosure in Alabama.

 

What records has this company reviewed before writing to you?

Remember this quote from the letter?

“Our firm has reviewed your records and we have authorization to stop the sale of your property once we are contacted.”

So what records have they looked at before they wrote you?

Now anyone can buy a list of the upcoming foreclosures.

But before this company sent you a letter, they apparently reviewed “your records”.  Maybe they reviewed your mortgage, your note, the default letter, the acceleration letter, etc.?

If so, that’s very impressive that before they sent an advertisement they took the time and money to pull your records.  And somehow got in your house to see the default and acceleration letters as those are not public records.  The mortgage is and some counties have them online — otherwise, they must have gone to your local probate court and physically pulled your mortgage.

Or.

They are just saying this to make it sound like they have done some extensive research and know they can help you?

You decide which is more likely….

Can they really stop your foreclosure?

Here are the only ways to stop a foreclosure:

  1. Mortgage company decides to stop it
  2. You file bankruptcy and get an automatic stay — normally a terrible idea but it is possible
  3. You file suit as is your right under the mortgage to have the court decide whether foreclosure is allowable

This company is not a lawfirm so they can’t file bankruptcy for you.  (See this case example of why bankruptcy is normally a bad idea anyway).

It can’t sue for you as it is not a law firm so option three is out.

But maybe it can help convince your mortgage company to voluntarily stop the foreclosure?

 

What is an “experienced Foreclosure Specialist”?

Remember this from the letter?

“We will assign you an experienced Foreclosure Specialist to fight for your rights and get results.”

I understand what “experienced” means — it means someone has done this a lot.

So they are claiming they have folks with lots of practice — lots of real world experience.

And those folks are “foreclosure specialists” which means what?

I have no idea.

I suppose people that specialize in foreclosures.  Apparently stopping foreclosures.  So let’s see what they use as this might help us to understand how they are specialists.

 

What are the provisions of the “State Ordinance and Federal Law” that they use to stop your foreclosure?

The letter says these “Foreclosure Specialists”:

“They will use the provisions in the State Ordinanace and Federal Law to STOP your upcoming Auction and force your lender to negotiate an affordable monthly payment so you can keep your home.”

OK now we are getting somewhere.

Let’s see.

What is the “State Ordinance”?

I assume this Georgia company means “Alabama” law.  No one I know of ever calls our laws the “ordinance”.  This is a word normally used of city laws such as “The City of Birmingham passed an ordinance banning smoking in restaraunts” or something like this.

So I’m not sure what they mean.

Perhaps they mean the Alabama laws related to foreclosures but that is an odd way of saying it.

It is true that my lawfirm in lawsuits uses Alabama law to stop foreclosures but I’m not sure how a non lawyer firm that cannot file a lawsuit does this.

What about the “Federal Law”?

Now that can be helpful.

FDCPA — Fair Debt Collection Practices Act.

FCRA — Fair Credit Reporting Act.

RESPA — Real Estate Settlement Procedures Act.

TILA — Truth In Lending Act.

The big question is “How” isn’t it?

I have no earthly idea.

If you decide to contact them, ask them.

“How will you stop the foreclosure?”

See if you get specific answers or vague generalities.

The scammers use vague generalities.  They’ll say things like this:

We use our extensive knowlege of the mortgage industry and intimate understanding of the law as well as a detailed audit of your mortgage documents to force the mortgage company to stop the foreclosure.

OK.

What does that mean?

Consider asking

  • “Ok that sounds good but how do you get them to stop?
  • What laws?
  • What arguments do you make?
  • Do you file suit for me?
  • What provisions of my mortgage?
  • Do I file suit and you prepare the documents?
  • Do I mail a letter?
  • So do you call my mortgage company?
  • Explain the process to me in detail.”

See what type of answer you get.

If it satisfies you, then great.

If not, then keep looking.

Here is a typical answer we see when you ask them “How”:

Sorry I have no intention of explaining exactly how I stop your sale because a cunning person such as yourself would up and do it yourself.  I worked for a major FDIC insured bank for 11 years, have a total 19 years doing mortgages and the last 8 years doing modifications for a total of 27 years.  I know every in and out of the mortgage industry.   The sale stop is 100% guaranteed I’m not going extend you all these extra courtesy you’re requesting.  We stop 80 sales a week and nobody else has all these issues except you.

You may be completely satisfied and impressed with this type of response or you may not.  That’s your judgment call on what makes you comfortable and confident in this person.

But should you even call them in the first place?

 

Should you contact them or go a different route to save your home from foreclosure?

This is up to you.

My suggestion is if you are facing a foreclosure, does it make sense that you should get a lawyer or a non-lawyer to help you?

If a non-lawyer, then maybe call these or any number of the self-proclaimed experts at stopping foreclosures.  Do your due diligence.

If you decide you want a lawyer, should you get one that is licensed in Alabama or not licensed in Alabama?

There is an unlimited number of alleged lawyers (some are fake) in California and Florida and other places that claim to be able to help you here.  How do they do that if they are not licensed in Alabama?

Great question to ask them.

They’ll explain they have secret contacts at the mortgage companies — you decide if that sounds realistic or if you are being scammed.

If you hire a lawyer in Alabama, which one and what kind?

Find someone you trust — you have confidence in and who makes you feel comfortable with this person stopping the foreclosure and representing you in your fight with your mortgage company.
