How long after my chapter 7 discharge do I need to wait to file again?


 Hopefully after you are discharged from your Chapter 7 case you will not need to file bankruptcy again. However, statistics show that somewhere around 16% of people that file bankruptcy will eventually re-file bankruptcy. If you receive a Chapter 7 discharge you must now wait 8 years to file a new Chapter 7 case.

This 8 year period is from filing date to filing date. If you received a discharge on a prior Chapter 7 case, you may file a new Chapter 13 case 4 years later. Again, the time period is from filing date on the old case to filing date on the new case.
