Caverno v. Universal Savings Banc Holdings, Inc.; and Citibank (South Dakota), N.A.
Consumer sued Citibank (South Dakota), N.A.; and Universal Savings Banc Holdings, Inc. for violating state law as these defendants kept balances on consumer's credit reports even though the bankruptcy court had discharged the debts. Therefore, the accounts on the credit reports must say "discharged in bankruptcy" and show a zero balance as no money is owed. Read more about this case (PDF).
Crutchfield v. Universal Fidelity, LP
Universal Fidelity is a collection agency out of Houston, Texas that made multiple violations of the Fair Debt Collection Practices Act (FDCPA) which allows collection agencies to contact third parties (anyone other than the consumer or spouse or lawyer) only to obtain "location information" which is: (1)home address; (2) home phone; and (3) place of employment. In this case the debt collector University Fidelity contacted consumer's ex-spouse repeatedly when the collection agency had the contact information of consumer (as the collection agency had called consumer multiple times). Universal Fidelity also did more than seek the location information (which it already had) and instead disclosed details of the alleged debt which it claims consumer owes. Alabama consumer sued Universal Fidelity under the FDCPA and state law (invasion of privacy).
