Amos v. TransUnion, LLC; and National Credit Adjusters, LLC
Alabama consumer sued the debt buyer National Credit Adjusters, LLC after it sued the consumer and lost at trial. Alabama consumer disputed the debt with TransUnion and instead of removing the debt from the credit report (as the judge in the collection action said the consumer did not owe it) both National Credit Adjusters and TransUnion decided to keep the debt/account on consumer's credit report. Suit was brought under the Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice). Berry v. TransUnion, LLC; and Bank of America aka FIA Card Services, Inc
This is a case filed by an Alabama consumer against Bank of America (FIA Card Services) and TransUnion for repeatedly verifying and keeping on the consumer's credit report a large Bank of America account which is not the consumer's account. This large account appeared on her credit reports and the consumer disputed the account with both Bank of America and TransUnion on multiple occasions but neither defendant did anything to fix this injustice. The lawsuit alleges that the defendants violated the Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice). Cockrell v. T L Thompson & Associates, Inc.
Consumer discharged a subrogation debt arising from a car wreck. After the discharge the debt collector T L Thompson & Associates, Inc. started collecting the discharged debt. The complaint alleges violation of state law including misrepresentations (fraud) as T L Thompson had checked on this and told the consumer the debt was not discharged. This tricked the consumer into paying money on a discharged debt that is not owed. Read more about this case (PDF).
Curb v. TransUnion, LLC; Capital One Bank, HSBC, Ameriquest, Equifax, and Experian
Alabama consumer sued three furnishers or creditors (Capital One, HSBC, and Ameriquest) and the three major credit reporting agencies (Equifax, Experian, and TransUnion) related to false and inaccurate credit reporting. Multiple disputes and attempts were made by the consumer to resolve the matter but finally litigation began against the six defendants for violations of Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice).
