Brown v. Experian; and Trans Union

The debt buyer LVNV sued an Alabama consumer for a debt LVNV alleged that consumer owed. The judge in the collection lawsuit found in favor of the consumer and against LVNV ruling that consumer did not owe LVNV any money. Consumer then timely disputed the existence of the LVNV debt with the credit reporting agencies of Experian and TransUnion but they and LVNV decided to keep the debt on the credit reports in violation of the Fair Credit Reporting Act (FCRA) (FCRA) and Alabama state law. The consumer resolved the differences with LVNV and sued Experian and Trans Union.

Camp v. Equifax Information Services, LLC; and Capital Accounts, LLC

Alabama consumer sues the debt collector Capital Accounts, LLC for its wrongful reporting of a discharged dental bill. The debt was discharged and the consumer disputed it with Equifax. The account was corrected. Then the account re-appeared on the consumer's credit report with a balance. The consumer disputed it but Capital Accounts and Equifax decided to keep the false account on the consumer's credit report. Consumer sued Capital Accounts for violating the Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice). Curb v. Equifax, Experian, Capital One Bank, HSBC, Ameriquest, and TransUnion

Alabama consumer sued three furnishers or creditors (Capital One, HSBC, and Ameriquest) and the three major credit reporting agencies (Equifax, Experian, and TransUnion) related to false and inaccurate credit reporting. Multiple disputes and attempts were made by the consumer to resolve the matter but finally litigation began against the six defendants for violations of Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice). Ellis v. Experian Information Solutions, Inc; Equifax Information Services and Palisades Collections, LLC

Alabama Consumers sued the debt buyer Palisades Collection, LLC after it sued the consumer and lost at trial. Alabama consumer disputed the debt with Experian and Equifax and instead of removing the debt from the credit report (as the judge in the collection action said the consumer did not owe it) amazingly Palisades and Equifax and Experian decided to keep the debt/account on consumer's credit reports. Suit was brought under the Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct and malice). Henningsen v. Energen Corporation (aka Alagasco, Inc.), Credit Bureau Systems, Inc.; Franklin Collection Service, Nuvell Credit Company

This Alabama consumer filed for bankruptcy protection and received a discharge on the debts held by these four defendants - Credit Bureau Systems, Inc. (a collection agency out of Tuscaloosa, Alabama); Franklin Collection Service, Inc. (a national collection agency out of Mississippi); Nuvell Credit Company (a car loan company associated with GMAC); and Energen Corporation which most people still know as "Alagasco". Instead of reporting these accounts as "discharged in bankruptcy" and with a zero balance, the account balances were left on the consumer's credit reports. Suit was filed against all defendants for violations of state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice) and violations of the Fair Debt Collection Practices Act by the debt collectors Credit Bureau Systems, Inc. and Franklin Collection. Hicks v. Experian Information Solutions, Inc.; Equifax Information Services, LLC; Capital One Bank, and Wachovia Bank, National Association

An Alabama consumer sued all of the defendants under state law (defamatin, invasion of privacy, wantonness, intentional conduct, and malice) and under the federal Fair Credit Reporting Act law. The Capital One accunt was not reporting correctly and Capital One, Equifax, and Experian refused to correct it despite several disputes from the consumer. The Wachovia account was an identity theft account and it was not promptly removed when the consumer sent in his dispute and proof that it was not his. Read more about this case (PDF).

Hogue v. Palisades Collection, LLC; and Equifax Information Services

Alabama consumer sued the debt buyer Palisades Collection, LLC after it sued the consumer and lost at trial. After the Alabama consumer won the collection case, the consumer properly disputed the debt with Equifax and instead of removing the debt from the credit report (as the judge in the collection action said the consumer did not owe it) amazingly Palisades and Equifax decided to keep the debt on consumer's credit reports. This was true even though the judge said the consumer did not owe any money to Palisades. This critical fact was ignored by both Palisades and Equifax. Suit was brought under the Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Alabama state law (defamation, invasion of privacy, wantonness, intentional conduct, and malice).
