Robo Dialed Calls To Cell Phones:  Cost of $500 or up to $1500 Per Call?So how much money does a creditor or debt collector owe you if they have illegally called your cell phone with a computer dialer or a pre-recorded message in violation of the TCPA (Telephone Consumer Protection Act)?  If they made one or more robo dialed calls?

or up to $1500.

Per call.

While we still run into defense lawyers who don’t know the law and claim the damages are only for calls that you actually answer, the truth is we count every time your phone rings.

When you consider how often companies typically robo dial a cell phone, the numbers can add up very quickly.

50 calls is $25,000 or $75,000.

100 calls is $50,000 or $150,000.

So what’s the difference between $500 and the “up to $1500” per call?

It depends on whether the call was “willful” or “intentional”.

Now in our depositions, where we ask questions under oath of the companies who call, we have not yet had one say “We did not intend to dial the number.”

No they intended to dial your number.

They may say they didn’t intend to break the law but that’s not the question — when we are dealing with a big creditor or a major debt collector these guys all know what the law is and when they intentionally call your cell phone illegally, there are consequences.

Here’s the bottom line.  Document all the calls.
