FDCPA — Collectors Who Use “Fighting Words” Against You In Alabama.

FDCPAMany consumers don’t know that the Fair Debt Collection Practices Act (FDCPA) prohibits abusive language by the collector against you.

Not only is this disrespectful and undignified, it is also a violation of the FDCPA.

I was talking with a bankruptcy and criminal lawyer friend of mine — Jordan Copeland — about this subject and I liked the way he said it.

He told me “In criminal law we call that ‘fighting words.'”

I thought that was a great description.

When collectors cuss at you — when they hurl insults at you — when they talk to you like a dog — in ordinary terms we say they are trying to get into a fight.

Because they are cowards, they do this over the phone.

They do this to elderly people — to new mothers — to anyone they think they can intimidate illegally into paying money.

The solution?

Respond to this type of abusive language with fighting words of your own — a federal court lawsuit.

We find that shuts the collectors up as they know they can’t hide behind the phone and insult you — instead they have to stand in front of a judge and a jury.

Make these guys pay for their wrong behavior and abusive language.
